Consumer Court Penalises Builder for Delay in Execution of Housing Project

The third Additional Bangalore District Consumer Disputes Redressal Forum not only directed the builder refund the full amount that the home buyers had given as advance but also the builder had to pay 18% interest plus a penalty as the execution of a housing project was delayed.

With most of handovers at Elita Promenade delayed by almost two years, a similar ruling if the buyers go to the consumer court would perhaps bring down the cuirtans for the KPDL projects in India.

Then read this and know all that you always wanted to know The Karnataka Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1972 - KOFA deals with most of the problems apartment owners face with promoters of the buildings or neighbouring apartment owners.

Mysore Grahakara Parishat Mysore is fast becoming a city of apartment buildings. Impressed by the security of apartment living, thousands of people have invested in apartments. But many apartment owners may be facing problems with apartment builders (construction defects), neighbours (disputes concerning common areas) and City Corporation (disputes about property tax on the apartment). They may also face problems when they try to transfer the title of the apartment to others (through sale, gift or will) since they do not possess the required documents. The government has passed laws to make each apartment a heritable and transferable immovable property, but unfortunately, there is large scale violation of these laws.

To avoid such problems, apartment owners should obtain the following documents (notarised copies unless otherwise indicated) at the time of taking possession of the apartment:

1. Site allotment letter from CITB or MUDA
2. Site possession certificate from CITB or MUDA
3. Title deed for the site from CITB or MUDA
4. Khatha certificate from Mysore City Corporation to the original allottee
5. Latest property tax paid receipt from MCC
6. Encumbrance certificate from sub-registrar’s office
7. Completion report for the building issued by MCC
8. The plan for the building sanctioned by MCC
9. Letter from CHESCom providing electrical connection to the building
10. Deed of declaration from developer giving details of common area shares
11. Letter from developer handing over possession of apartment (Original).

The Karnataka Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1972 - KOFA deals with most of the problems apartment owners face with promoters of the buildings or neighbouring apartment owners.

KOFA defines the obligations of the promoter of an apartment building. Among these obligations are prompt and full disclosure of the nature of the promoter’s title to the land (as certified by a lawyer of seven years standing), any encumbrances on the land, nature of fixtures, fittings and amenities to be provided in the building, the design and materials to be used in the construction of the building, plans and specifications of the building having obtained approval of the local authorities for the same, details of all agreements with the architects and contractors, the date on which the possession of the flat will be handed over, details of all the outgoings including ground rent, income tax, property tax, water charges, electricity charges, revenue assessment, interest, etc.

According to KOFA, the promoter must also keep a list of the flat buyers along with the prices charged and the conditions under which the flats were sold. Further, the promoter must state in writing the precise nature of the organisation of apartment buyers to which title of the building is to be passed and the terms and conditions governing the organisation. If this organisation is a co - operative society, he has to submit an application to the Registrar of Co - operative Societies within four months from the date on which the minimum number of persons required to form the society have taken flats. If no period of conveying the title of the building to the co - operative society thus formed is previously agreed upon, the promoter has to convey the title to the society within four months of the date on which the society is registered.

KOFA forbids the promoter from allowing persons to enter into possession until completion certificate for the building is obtained from the competent local authority. Before accepting advance payment or deposit from any buyer, the promoter has to enter into an agreement with the buyer and the agreement has to be registered. The advance payment cannot exceed 20% of total sale value of the flat. Once the agreement is executed, the promoter cannot mortgage or create a charge on the flat or the land.

KOFA mandates that the promoter has to maintain a separate account of sums taken as advance or deposit and acting as a trustee for the money, disburse it for the purpose for which it is given, keeping full records of the money spent. The promoter has the responsibility for the payments of all outgoings including taxes, water and electricity charges, revenue assessment and interest until the title of the property is transferred to the cooperative society of flat owners.

The apartment buyers are advised to go through these records carefully and insist on details since some promoters have charged huge lump sum amounts for purposes such as registration of apartments and legal fees, etc., which required only small amounts of money. Some promoters are also found collecting money for various heads to meet the hidden costs which the buyers are not obliged to pay.

After the plans and specifications of the building as approved by the local authority are disclosed to the person agreeing to take a flat, the promoter is forbidden by KOFA to make
i) Any alteration within the flat without obtaining previous permission of that person, or
ii) Any alteration in the structure of the building or construct additional structures without the previous consent of all the persons who have agreed to take the flats.

If the promoter fails to give possession of a flat duly completed in accordance with the terms of the agreement by the date specified (or any further date agreed to by the parties), he shall be liable to repay (without prejudice to other remedies to which he may be liable) the amounts already received by him with respect to the flat with simple interest at 9 % per year. Any violation of the above conditions of KOFA by the promoter is punishable by a prison term or a fine or both.

To guarantee a smooth running of the co - operative society of apartment owners, it is advisable that all members of the society give a declaration to the Registrar of Co - operative Societies stating that they want to be covered by Karnataka Apartment Ownership Act 1972 (KAOA).

KAOA and the accompanying Rules prescribe the way the society has to be run, the duties of apartment owners, etc. They forbid actions of any owner which would jeopardize the soundness or safety of the building reduce the value of the building or hinder or encroach upon the lawful rights of other apartment owners. They also enjoin all owners to perform promptly maintenance and repair work within their own units and to reimburse the society for any damage to common area and facilities through their fault. KAOA mandates that the promoter should provide each apartment owner a deed of declaration in the format prescribed by Form A. The apartment owners should make sure that they receive the deed in the prescribed format.

A book containing both these Acts applicable to apartments in Karnataka and the accompanying Rules is available in law book stores.

Elita Promenade wins Best Development Award for India

“Joke of the Decade!” was the title of the post when one of the home Owners’ of Elita Promenade, Bangalore posted this clipping of the advertise on the home owners group that appeared on the Times of India on Friday, 05 June 2009 which can also be viewed at http://epaper.timesofindia.com (look for the Bangalore edition page 40).

The MSNBC site, residentialpropertyawards.net which the award states that “Judges are impartial, and award points solely on the basis of the entry that they look at, with no value attached to prior reputation or other issues” hence, the prominence of the award is indeed questionable. Wonder what the judges had a look at that made them bestow the award to Elita Promenade, a join venture between KEPPEL LAND, Singapore and Puravankara Projects Limited, Bangalore. Unfortunately, they do not have a phone number listed on the website to question the decision.

A vast majority of the people who were expecting to get possession of their apartments in Dec 2007 are still waiting; a few unlucky ones still do not have a sight of the day when they would get possession. Those who have had possession after a delay of about 1.5 years, had complains about the finishing and the actual carpet area.

As mentioned in one of the prior articles “Do read finer prints before you commit“, prospective buyers should take a close look at the fine prints. If you expect a smooth international quality service banking on the brand name “KEPPEL LAND, SINGAPORE”, you are bound to be surprised after you sign the contract. As one of the KEPPEL LAND officials stated in one of the meetings with the home owners, irrespective of what they advertise, “This is INDIA and you are not paying [SINGAPORE] DOLLARS

They are plumbers working on the Elita site and has done quite a few installations and know the requirements. You will need inlet and outlet pipes which you can procure when buying the geysers. You can speak to them before you purchase. They will charge Rs.350 per geyser for installation.

Mosquito Mesh

He too works at the site and has done some mesh installations. I came to know him later after I had got the mesh installed by somebody else. Not too happy with their work and they seem to have overcharged me. This Chote Lal quoted Rs.18000. I paid 20000 to the other guy. For living room and MBR balconies and bedroom. You do get mosquitoes and other nocturnal insects invading the apartment at nightfall if you don’t have the mesh. Again you can check in the model flat on how the mosquito mesh can be installed.

Note that the balcony and MBR doors have a spring locking system that can be opened from only inside the unit. If you go out into the balcony and close the door behind you, you will be locked out. This is dangerous. Getting attention from a high floor will be a problem. The only way is to bread the main door lock to come in and open the balcony door. I know of one owner who got locked out for 30 mns. Luckily his main door was open and the guy who was doing the electrical fitting who had gone out to buy something returned and let him in. My wife and kid got locked out for 20 mns when I had gone out to buy something. Fortunately, I had the main door key with me. Suggest, if you are on higher fllor, get the part where the latch goes in to be removed from the balcony doors till you find a safer locking solution. I am still looking for one.

KPDL Issues : Do read finer prints before you commit

With the KPDL (Keppel Puravankara Development Limited) already late in delivering the apartments (the promised delivery date was Dec 2007), the select few home owners who have been intimated of the handover (of the first 2 blocks) are facing various issues with the quality of the apartments.

The delivery of the remaining blocks are further delayed. Most of the home owners have been informed that the apartments would be delivered by Dec 2008 but, the people who have visited the site strongly feel that the project might not make it by the delivery date.

KPDL does promise international quality apartments in the advertisements and while the prospective buyers approach their sales team. However, according to a senior Keppel Land official, during a meeting with a few dissatisfied owners, the quality of the apartments would not be close to the ones of their solo projects in Singapore as this project is in India and the amount paid is in Indian Rupees and not Singapore Dollars.

The home owners who have already signed the contract (with or without reading the finer prints) are now at the mercy of KPDL now claim that they would go by the papers irrespective of what their sales people verbally committed while selling you the apartment. A couple of points that are now bothering the home owners which probably should have been caused a greater concern while signing the contract are:
1. You would need to pay 24% interest if your payment is delayed.
2. They have a 6 month grace period after the promised handover date only after which the owners would be paid a very nominal compensation. If any of the payments are delayed by the home owner, the owner would forfeit the compensation.

Elita Promenade : Luxury Apartments in JP Nagar 7th Phase Bangalore

Elita Promenade is a one of the most upscale apartment complex under construction in JP Nagar 7th Phase, Bangalore. Being a joint venture between Singapore’s largest property developers, Keppel Land and the well known Puravankara Projects Ltd. Being the first venture by the Singapores’ developer, anticipation is that the project would be one of the best in India.
